Financial Services

Retained by the representative plaintiff in a class action dispute with an insurance company regarding alleged improper administration of certain policies. The parties entered into a settlement agreement and our role was to ensure that all affected policyholders were included in the settlement and that the restitution amounts were calculated in accordance with the terms of the settlement agreement. Our work included designing and performing tests on the excluded policyholders to ensure there were no improper exclusions and reviewing the model developed by the defendant to calculate restitution. The model was revised to reflect various errors that we identified. We ensured the restitution amounts were properly calculated and paid to the affected policyholders.

Franchise

Retained by the representative plaintiff in a class action dispute brought by franchisees against the franchisor. The plaintiffs’ alleged that the franchisor was not complying with the terms of the franchise agreements and was operating in a way that disadvantaged all franchisees. Our work included reviewing productions and conducting interviews with various franchisees. Our work product included preparation of affidavits relating to our ability to, as well as our approach for, the quantification of losses on both an individual and aggregate basis. 

Financial Services

Retained by a large financial institution that identified a systemic error in the manner in which interest charges were being calculated on certain credit cards issued by the financial institution. A team was assembled internally to identify all affected card-holders and calculate the amount required to make each card-holder whole, including paying interest from the date of the improper calculation up to the expected remediation payment date. Our work involved examining the work of the internal team in respect of identifying affected card-holders, calculating the remediation amounts, and verifying that the repayments made were consistent with the remediation calculations.
